Terms and conditions
These cashback terms and conditions (“Cashback Terms and Conditions”) apply in addition to and comprise part of the foodpanda Terms of Use (“Terms of Use”) as set out in https://www.foodpanda.ph/contents/terms-and-conditions.htm and the Pandapay Terms and Conditions (“Pandapay T&Cs”) as set out in https://www.foodpanda.ph/contents/pandapaytermsandconditions.
1. When you make a successful Order (as defined in the Terms of Use) from the vendors listed on the Platform (as defined in the Terms of Use) (“Vendors”), you may be eligible to receive a percentage of the Order value or a fixed amount (“Cashback(s)”) into your Pandapay Account (as defined in the Pandapay T&Cs). Delivery fees, service fees and any discounts or vouchers applied to your cart will not count towards your Cashback calculation.
2. The balance in the Pandapay Account cannot exceed the Maximum Balance as set out in the Pandapay T&Cs at any point of time. You will not be able to receive Cashbacks to your Pandapay Account if the Cashback will cause the balance to exceed the Maximum Balance.
3. The Cashback will be credited to your Pandapay Account immediately after you make an eligible Order that was paid and delivered, unless otherwise stated.
4. Orders that are cancelled are not eligible for Cashback. In the event of a cancellation of your Order, foodpanda reserves the right to claw back the Cashback credited, or to charge the amount of the Cashback credited to you.
5. If there is a refund on the Order, and/or the Order value goes below the minimum spend required, foodpanda reserves the right to claw back the Cashback.
6. Your Cashback is not transferable.
7. Your Cashback will be available in your Pandapay Account and can be applied to your next eligible Order on our Platform.
8. Cashbacks are subject to validity periods (as specified in the Cashback campaign terms), use restrictions, limits and/or other availability. All Cashbacks are subject to availability on a ‘while stocks last’ basis.
9. foodpanda reserves the right to exclude the use of the Cashback for certain Goods (as defined in the Terms of Use) or Orders at its sole and absolute discretion.
10. Your Cashback is non-refundable, non-exchangeable for cash and is not a liability owed to you by any foodpanda and/or any Vendor on the Platform.
11. Where foodpanda reasonably determines that you are not eligible for the Cashback, including where the Cashback was awarded due to an error, foodpanda reserves the right to claw back the Cashback amount without prior notice.
12. In the event that foodpanda has reasonable suspicion of fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with redemption of Cashback on the Platform, foodpanda is entitled at its sole discretion to deduct any Cashback.
13. foodpanda’s decision on all matters relating to the Cashback shall be final. If there are any discrepancies between these Cashback Terms and Conditions and any brochure, marketing or promotional material relating to any Cashback campaign, the Cashback Terms and Conditions will prevail.
14. In case of restaurant/s specific Cashback campaigns, and such restaurant is no longer on the platform, or decides to no longer participate in the Cashback campaign, any Cashback issued for that restaurant will be retrospectively removed from your account.
15. foodpanda shall not be responsible for any failure or delay in transactions which may result in you being omitted from enjoying the Cashback.
16. foodpanda reserves the right to change or modify the Cashback Terms and Conditions at any time.
17. foodpanda reserves the right to suspend or terminate the Cashback campaign at any time without prior notice or liability to any party.
