foodpanda Pay Refund Account Policy (Philippines):

2. The foodpanda Pay Refund Feature:
In Philippines, foodpanda will in accordance with the terms of this Policy provide you with access to and the use of the refund balance feature (“foodpanda Pay”) on the Platform which shall be a virtual account which may allow you to do the following:
(ii) utilize the Refund Balance in your foodpanda Pay account towards payment for your future Order/(s) made on the Platform.
Note: We do not currently refund change payable to you on Cash on Delivery Orders (“COD”) to foodpanda Pay and such amounts will only be refunded to credit card or debit card.
Refunds for online transactions on the Platform where the payment was completed via third party wallets will only be processed to the respective third party wallet account from which the payment was made and not to foodpanda Pay.
3. Mode of Refund:
b. Other Modes of Refund: You may at any time opt out from the Default Mode of Refund in Section 3a above by changing your preferences in the Settings and adding the instrument (i.e credit or debit card) or verified bank account to which you would like to receive Refunds from foodpanda. However, Refunds to cards or bank accounts can take between seven (7) to ten (10) business days and will not be instantaneous.
4. Permitted Use of Refund Balance:
a. The total balance available in foodpanda Pay will be displayed as the Refund Balance. The Refund Balance can only be used toward payment for future Orders made on the Platform.
b. Should you choose to utilise your Refund Balance in foodpanda Pay for an Order and the value of that Order exceeds the value of your Refund Balance in foodpanda Pay, your Refund Balance shall be utilised in full and the balance amount of your Order shall be charged to the online payment method chosen by you.
c. Should you choose to utilise your Refund Balance for an Order and the value of that Order is less than the Refund Balance in foodpanda Pay, foodpanda will only deduct the value of the Order (including delivery fees and any applicable tax) from your Refund Balance. Any unutilised Refund Balance shall remain in the foodpanda Pay account and maybe used towards subsequent orders through foodpanda’s Platform.
5. Validity of Refund Balance:
The Refund Balance reflected in your foodpanda Pay account will be redeemable while you have a valid account with foodpanda and shall not expire. In the event that your foodpanda account terminates or you wish to close your foodpanda account, you may redeem the entire outstanding balance in foodpanda Pay by making a purchase on the Platform before closing the foodpanda account. Any outstanding balance in foodpanda Pay at the time you close your foodpanda account will be forfeited.
6. Usage Limitations and breach of contract:
a. Although the Refund Balance will be denominated in philippine peso (PHP), the Refund Balance in foodpanda Pay cannot be withdrawn as cash , transferred to a bank account or credited to a debit card, credit card or any other third party operated payment instrument. The Refund Balance cannot be transferred to another foodpanda account or to another person.
b. The Refund Balance cannot be used in any manner which in foodpanda’s sole discretion and determination, contradicts the intended purpose and closed-loop nature and functionality of foodpanda Pay, or is otherwise in breach of this Policy, or disrupts, and/or is harmful to other users of the Platform and/or otherwise disrupts and/or is harmful to the reputation, goodwill, business, security, reliability, or operations of the foodpanda Platform. Without prejudice to the generality of the foregoing, you shall not use the Refund Balance in foodpanda Pay:-
(i) outside the Platform or foodpanda account as a generic payment method, payment instrument or any feature of a similar nature; or
(ii) as consideration for the performance of a contract with a third party; or
(iii) for resale or trade or exchange thereof, whether for cash or otherwise, or for commercial purposes; or
(iv) for any illegal or unauthorized purpose.
a. All Refunds once issued are final and foodpanda will not entertain further requests regarding your Refund. foodpanda is not obliged to provide reasons for refusing any Refund or the amount of any Refund.
b. All data and information in and showed to you in your foodpanda Pay account, including the Refund Balance, are believed by foodpanda to be accurate to the best of its knowledge. Because of the possibility of human and mechanical error, delays or interruptions, system downtime, and other factors, however, all data and information in and shown on foodpanda Pay, are provided “as is” without any warranty of any kind. In particular, to the fullest extent permitted by law, foodpanda makes no representation or warranty, express or implied, as to the accuracy, timeliness, completeness, merchantability, or fitness for any particular purpose of such data and information. To the fullest extent permitted by law, foodpanda shall not be liable in contract or otherwise for any direct, indirect, or consequential loss or damage sustained by you or any other party by the direct or indirect use of or reliance on foodpanda Pay or the data or information therein and shown thereon.
c. Additional terms and restrictions may apply to the Refund Balance in foodpanda Pay which will be notified to you from time to time.
d. foodpanda may amend or cancel this Policy at any time in its sole discretion by updating this page or through e-mail communications which will be circulated to your registered e-mail address. foodpanda may remove the foodpanda Pay feature in its sole discretion at any time, provided that if we do so, we will on a best effort basis provide reasonable advance notice to give you time to utilise any outstanding balance in foodpanda Pay account.
